Thank you for choosing the YumiAI platform (“YumiAI” or “Platform”). The YumiAI platform and related services are provided to you through web pages, applications (which may include different versions), browser plugins, mini-programs, software development kits (SDKs) for third-party websites and applications, application programming interfaces (APIs), and other innovative forms that emerge with technological development. This Policy applies to personal data we collect through the YumiAI platform, mobile apps, desktop software, official website, and any other functions, features, or services now or in the future (collectively, the “Services”).

Please note that this Policy does not apply to third-party products, services, websites, or content (“Third-Party Services”). Such services are governed by their respective privacy policies, and we recommend reviewing their privacy statements before use.

a) Contractual Necessity: Necessary for the conclusion, performance, and management of the Terms of Service (e.g., creating and managing accounts, providing core functions, processing payments/subscriptions, delivering content, responding to service requests, etc.); b) Consent: Rely on your consent when required by law or for optional features (e.g., subscribing to marketing emails, participating in surveys or beta programs, allowing access to certain device data like precise location). You may withdraw consent at any time via settings or by contacting us; withdrawal does not affect the lawfulness of processing based on consent before withdrawal; c) Legal Obligation: To comply with laws and regulations (e.g., tax, accounting, responding to competent authority requests, identity verification, fraud/sanctions/anti-money laundering checks, fulfilling data subject rights); d) Legitimate Interests: To ensure the security of the Services and business, prevent fraud/abuse, develop and improve products, conduct marketing where consent is not required, etc. We will ensure these interests do not override your fundamental rights and freedoms; e) Vital Interests: In rare cases, to protect the vital interests of a person (e.g., emergency safety incidents); f) Legal Claims: To establish, exercise, or defend legal claims; g) Other Lawful Bases: If applicable law provides additional bases, we will explain at the time of collection. Generally, when providing and managing the Services for you, we act as a “data controller” (GDPR) or “business provider” (CCPA/CPRA). However, when processing personal data on behalf of a corporate client under an agreement (e.g., a company creates platform accounts for its employees), we act as a “data processor” or “service provider,” and such processing is governed by the contract with that client, not this Policy.
We do not sell your personal information. However, to the extent permitted by law, we may share your information with third parties for the following purposes, including but not limited to:
We engage trusted third-party vendors and partners to operate, improve, and support the Services, including:
Payment processors that securely handle transactions;
Cloud/hosting service providers that host and manage infrastructure;
Analytics and measurement vendors that help us understand performance and usage;
Advertising and marketing partners where permitted by law and consistent with your preferences.
These third parties are bound by strict contractual obligations to process data only on our behalf and in accordance with this Policy.
We may share information with companies within our corporate group (including subsidiaries, parent companies, and affiliates under common control) to:
Operate and optimize the Services;
Improve products and features;
Conduct internal reporting and business planning.
If these entities are located outside your jurisdiction, we will take appropriate safeguards as described in the “International Data Transfers” section.
We may disclose information to law enforcement, regulators, courts, or other third parties if we believe in good faith that doing so is necessary to:
Comply with applicable laws, legal processes, or legitimate requests;
Enforce our Terms of Service or other agreements, or investigate potential violations;
Detect, prevent, or address fraud, security, or technical issues;
Protect the rights, property, or safety of the company, our users, or the public;
Establish, exercise, or defend legal claims.
In the event of a corporate transaction (such as a merger, acquisition, asset sale, financing, restructuring, reorganization, bankruptcy, etc.), your information may be shared or transferred. In such cases, we will require the recipient to comply with this Policy or provide equivalent protection.
If you consent or direct us, we will share your information with third parties for other purposes. When required by law, we will obtain your explicit consent in advance.
We may store and process your personal information on servers in other countries. Currently, data is primarily stored on secure servers in the United States, and we may also engage affiliates and service providers in other countries to support operations.
If you access the Services from the EU, UK, or Switzerland and your personal information is transferred to a country without an adequacy decision, we will take appropriate safeguards as required by law, such as EU Standard Contractual Clauses (and UK addendum, etc.), supplemented by technical and organizational measures to protect your data.
You can view or update most of your personal information by logging into your account at any time. We also provide additional privacy controls in settings to help you manage preferences and permissions.
Depending on your location and applicable law, you may have the following rights:
a) Access and Confirmation: Request confirmation of whether we process your personal information and obtain a copy of the data we hold; b) Correction: Request that we correct inaccurate or incomplete personal information; c) Deletion (Right to be Forgotten): Request that we delete your personal information under certain circumstances (subject to legal or contractual obligations); d) Restriction of Processing: Request that we restrict processing of your personal information under certain circumstances; e) Data Portability: Request that we provide your personal information in a structured, commonly used, machine-readable format and transmit it to another data controller, where technically feasible; f) Withdraw Consent: If processing is based on your consent, you may withdraw it at any time, without affecting the lawfulness of processing based on consent before withdrawal; g) US Residents – Sale & Targeted Advertising Opt-Out: Where applicable (e.g., CCPA/CPRA), you may opt out of the sale or sharing of your personal information or its use for cross-context behavioral advertising; h) Object to Processing: Under certain circumstances, you may object to our processing of your personal information, including processing for direct marketing; i) Right to Complain: If you believe our processing violates your privacy rights, you may lodge a complaint with your local data protection authority. We will require the agent to provide your written authorization or power of attorney, and may still need to verify your identity directly.
Not absolutely secure. We take reasonable technical and organizational measures to protect the personal data you provide, but we cannot guarantee absolute security. Any transmission risk is borne by you.
To help us protect your personal data, please use a strong password, do not share it with others, and do not reuse the same password on other websites. We also recommend that you refrain from sending sensitive information to us via unencrypted email.
We generally retain your information for as long as necessary to fulfill the purposes for which it was collected and to provide you with the Services. In some cases, we may retain information for longer periods to comply with legal obligations or to establish, exercise, or defend legal claims.
When you stop using the Services, we may retain your information in aggregated or anonymized form. Additionally, we may continue to retain necessary information for a reasonable period to comply with legal obligations, resolve disputes, and enforce our agreements.
These Services are not directed to children under 13 (or the minimum age prescribed by the relevant jurisdiction). If you believe we possess or have collected personal data from a child, please contact us at service@yumiai.com.
We may update this Policy from time to time to reflect changes in practices, technology, legal requirements, or other factors. If we make material changes, we will notify you within the Services or through other reasonable means, and update the “Last Updated” date at the top of the Policy.
We encourage you to review this Policy periodically. Your continued access or use of the Services after the updated Policy becomes effective constitutes your acceptance of the revised Policy; if you do not agree, please stop using the Services.
